This fourth edition of the case-law of national courts on intellectual property (IP) provides new summaries of national courts’ judgments in the area of intellectual property crime (IPC), touching on some of the most prevalent legal issues in this crime area. The cases selected deal with a range of issues, including illegal IPTV, counterfeiting of everyday goods, the issue of non-material damages and calculation of damages.
This and previous versions of the case-law report aim at demonstrating how national courts in EU jurisdictions interpret and apply the main legal provisions governing IP crime. The document provides links to the full text of the judgments in their original language and makes references to the applicable legal provisions in national and European laws.
The case-law overview is not an exhaustive document and it should not be used as a replacement of the full text of the judgments analysed therein. Instead, it is intended to be used for reference and as a supplementary resource for practitioners in this field.
This publication was prepared within the framework of the Intellectual Property Crime Project, launched in March 2021 on the basis of a Service Level Agreement signed between the European Union Intellectual Property Office (EUIPO) and the European Union Agency for Criminal Justice Cooperation (Eurojust).
