For competent authorities worldwide, the effective investigation and prosecution of crime increasingly depend on timely access to digital data and the ability to rely on electronic evidence. As legislation governing the digital sphere continues to evolve, this report reflects on the increasingly complex – and in many respects divergent – legal landscape surrounding cross-border access to electronic evidence. While the situation in 2024 remained largely unchanged, significant legislative and operational developments are forthcoming and are expected to substantially reshape the framework for cross-border access in the near future
