Migrant smuggling by sea often occurs in international waters or areas beyond any single state’s territorial jurisdiction. This creates complex legal challenges regarding which country can investigate, intercept and prosecute those responsible, especially in tragic cases involving shipwrecks and mass casualties. The purpose of this leaflet is to raise awareness of this issue among judicial practitioners, law enforcement and lawmakers.
