E-Evidence in focus at Eurojust and Council of Europe joint cybercrime workshop

Eurojust and the Council of Europe (COE) joined forces this week to tackle the growing challenge of cybercrime, with a particular focus on the importance of cross-border exchange of e-evidence in investigating and prosecuting these complex crimes.

As part of their ongoing cooperation, Eurojust and the COE jointly hosted a workshop on the Second Additional Protocol to the Budapest Convention on Cybercrime, held at Eurojust's premises in The Hague from 29-30 September 2025.

The joint workshop brought together experts from EU Member States and other Parties to the Cybercrime Convention (Budapest Convention), including individuals serving as main interlocutors for the implementation of the Second Additional Protocol, to discuss the latest developments and best practices in this field. The event aimed to increase participants' knowledge of the provisions and mechanisms of the Second Additional Protocol, identify challenges and legislative ambiguities in its implementation process, and facilitate the exchange of views and good practices regarding the application of the mechanisms and tools offered by the Protocol.

Various topics were covered over the two-day event, including the introduction to Article 6 and Article 7 of the Second Additional Protocol, legislative and other measures under consideration, and cooperation with private entities. The event provided an opportunity for participants to share their experiences and best practices in implementing the Second Additional Protocol.

The interplay between the Second Additional Protocol and instruments such as the EU e-evidence regulation, within broader legal frameworks and human rights safeguards, presents ongoing challenges for legislators and practitioners. This complex legal landscape was a key focus of the discussions, underscoring the need for coordinated and consistent approaches.

The joint workshop marked a significant milestone in the partnership between Eurojust and the COE, demonstrating their commitment to strengthening global efforts to combat cybercrime.
