Battlefield Evidence: Key insights for judicial practitioners

Accountability for terrorist offences and core international crimes (CIC) is a priority for the European Union. Investigating and prosecuting these acts is complex and challenging, not least because evidence may be located in or obtained from an armed conflict: in other words, from the battlefield.

Battlefield evidence is used increasingly in Europe to prosecute terrorism, CIC and for cumulative prosecutions for both crime types. Eurojust prepared this booklet to support judicial practitioners in tackling the growing number of cases. The publication is a practical, easy-to-use tool, covering battlefield evidence as a concept, how to access such information and how to use it in court, including the use of new technologies and international cooperation in the field.

The booklet was prepared, in addition to the expertise of Eurojust, based on reports drawn up in cooperation with the Genocide Prosecution Network and a meeting held in April 2024.
