Powers of National Members

In accordance with its own legal system, each EU Member State seconds a National Member to Eurojust, and their regular place of work is at the Agency’s premises in The Hague. Each National Member is assisted by a Deputy and an Assistant. National Members and their Deputies are selected by their respective Member State. They shall have the status of a prosecutor, a judge or a representative of a judicial authority with competences equivalent to those of a prosecutor or judge under national law. Together, the National Members form the College of Eurojust.

Powers

The National Members at Eurojust have the power to facilitate or otherwise support the issuing or execution of requests for mutual legal assistance (MLA) or mutual recognition, and to directly contact and exchange information with competent national authorities of their respective Member State, as well as competent bodies of the European Union and competent international authorities, in accordance with the international commitments of their Member State. The National Members may also participate in and assist in the setting up of joint investigation teams (JITs).

Access to registers

Eurojust’s National Members have access to or are able to obtain information contained in the following types of registers of their respective State, in accordance with the State’s national law:

criminal records;
registers of arrested persons;
investigation registers;
DNA registers; and
other registers of public authorities of their Member State where such information is required to fulfil tasks of the National Member.
