Strategy of the Genocide Network

Strategy to combat impunity for the crime of genocide, crimes against humanity and war crimes within the European Union and its Member States

On 30th October 2014, the Genocide Network formally adopted the ‘Strategy of the EU Genocide Network to combat impunity for the crime of genocide, crimes against humanity and war crimes within the European Union and its Member States’. The Strategy demonstrates that with 1 339 ongoing cases or investigations in Member States of the European Union, the fight against impunity is a real and current issue facing national authorities. The Strategy is based upon practitioner’s experience and knowledge, and reflects the lessons learned and best practice of prosecutors, investigators and other experts in this field, as well as the discussions of past Genocide Network Meetings.

The Strategy distinguishes a comprehensive set of measures that EU Institutions and Member States should take to support national authorities in combating impunity, holding perpetrators to account and delivering justice to victims. In doing so, it is hoped that it will strengthen the commitment of EU institutions and Member States to combating impunity for core international crimes, raise awareness of the challenges in investigating and prosecuting core international crimes, and develop the practice of national authorities.

The Genocide Network, through its contact points at national level and the Network Secretariat at EU level, will use the Strategy as a framework to guide the Genocide Network’s continued development in coming years and to advocate for greater EU and Member State engagement.

On 15-16 June 2015, the Justice and Home Affairs Ministers of the Member States adopted the Council Conclusions on strengthening the fight against impunity for the crime of genocide, crimes against humanity and war crimes within the EU and its Member States. The importance of the document - which refers directly to the Strategy - lies in the recognition and endorsement of the Strategy, and thus offers the renewed commitment of the EU and its Member States to fight impunity for core international crimes.

The Council of the EU acknowledged that the Strategy is a stocktaking document, based upon the work of practitioners across Member States and upon lessons learned and best practice identified by prosecutors, police investigators and other experts in the field. At the same time, it reflects the discussions and conclusions of the 17 meetings of the Network over the past 12 years.

By adopting the Conclusions, Member States have a comprehensive reference tool for strengthening national capabilities, procedures and structures in combating core international crimes. Moreover, Member States and EU institutions are invited to implement the measures, identified by the Network, at national and EU level.
